In case the owner is married the homestead cannot be sold or mortgaged, except for an unpaid portion of the purchase money, without the joinder of husband and wife, and if the owner dies leaving a spouse or minor children, the homestead with its exemptions descends to the surviving member or members of the family.
A husband owning a homestead is debarred from selling or mortgaging it without the joinder of his wife, and if the husband dies leaving a widow or minor children the homestead passes to either or to both jointly, and may be so held until the youngest child is twenty-one years of age or until the marriage or death of the widow.

A husband may, however, convey his real estate, other than a homestead, by his separate deed, whereas a wife's deed for her real estate is void without the joinder of her husband.
